By downloading, installing, or using EchoCraft, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use EchoCraft.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of EchoCraft ("the Software", "the Application", "we", "us", or "our"), a voice-to-text transcription application developed by MANTISWARE.

By accessing or using EchoCraft, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Software.

2. License Grant

2.1 Free Trial

EchoCraft may be downloaded and used for evaluation purposes free of charge. The free version may have limitations on features or usage.

2.2 Purchased License

Upon purchase of a license, you are granted a non-exclusive, non-transferable license to:

  • Install and use EchoCraft on your personal devices
  • Use EchoCraft for personal or commercial purposes
  • Receive version 1.x updates at no additional cost

2.3 License Restrictions

You may not:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Remove or alter any copyright notices or proprietary labels
  • Use the Software to violate any laws or regulations
  • Share your license key with others
  • Resell or redistribute the Software

3. Payment and Refunds

3.1 Pricing

EchoCraft is available for a one-time purchase price of $9.99 USD. Prices may vary by region and are subject to change without notice.

3.2 Payment Processing

Payments are processed by Gumroad, a third-party payment processor. By making a purchase, you agree to Gumroad's terms and conditions.

3.3 Refunds

Refund requests must be made within 30 days of purchase. Refunds are granted at our discretion and may be subject to verification. Contact support@mantisware.co.za for refund requests.

3.4 License Validity

Your license is valid for:

  • All version 1.x updates
  • Use on your personal devices
  • Lifetime use (no expiration)

Major version upgrades (2.x, 3.x, etc.) may require a new license purchase.

4. Use of the Software

4.1 Permitted Uses

You may use EchoCraft for:

  • Personal transcription needs
  • Commercial transcription services
  • Accessibility purposes
  • Any legal purpose that does not violate these Terms

4.2 Prohibited Uses

You may not use EchoCraft to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transcribe content without proper authorization
  • Create or distribute harmful, illegal, or offensive content
  • Interfere with or disrupt the Software's operation
  • Attempt to gain unauthorized access to any systems

4.3 AI Assistant Features

Important: AI Assistant features require your own third-party API keys. You are responsible for:

  • Creating accounts with AI providers (OpenAI, Anthropic, Azure, or Ollama)
  • All costs charged by AI providers
  • Compliance with AI provider terms of service
  • Any content generated or processed through AI features

EchoCraft does not provide, resell, or charge for AI services. We are not responsible for AI provider costs, availability, or content.

5. Intellectual Property

5.1 Ownership

EchoCraft and all associated intellectual property rights are owned by MANTISWARE. The Software is protected by copyright laws and international copyright treaties.

5.2 Third-Party Components

EchoCraft includes third-party open-source software:

  • whisper.cpp: Licensed under MIT License
  • Electron: Licensed under MIT License
  • Other dependencies: Various open-source licenses

Third-party licenses are available in the application or source code.

5.3 User Content

You retain all rights to content you create using EchoCraft. We do not claim ownership of your transcriptions or generated content.

6. Disclaimers

6.1 No Warranty

ECHOCRAFT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

6.2 Accuracy Disclaimer

While EchoCraft strives for accuracy, transcription results may contain errors. We do not guarantee:

  • 100% accuracy of transcriptions
  • Perfect recognition of all accents or dialects
  • Error-free operation
  • Compatibility with all audio sources

You are responsible for reviewing and verifying transcription accuracy.

6.3 Third-Party Services

EchoCraft may integrate with third-party services (AI providers, model repositories, payment processors). We are not responsible for:

  • Availability or performance of third-party services
  • Costs charged by third-party providers
  • Content or data handled by third-party services
  • Compliance with third-party terms of service

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANTISWARE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Errors or inaccuracies in transcriptions
  • Interruption of service or loss of data
  • Costs of substitute products or services

Our total liability shall not exceed the amount you paid for the Software.

8. Indemnification

You agree to indemnify and hold harmless MANTISWARE from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of EchoCraft
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or transcribe using EchoCraft

9. Updates and Modifications

9.1 Software Updates

We may release updates to EchoCraft that include bug fixes, new features, or improvements. Updates may be:

  • Automatic (if enabled in settings)
  • Manual (requiring user download)
  • Required for continued functionality

9.2 Terms Updates

We reserve the right to modify these Terms at any time. Material changes will be:

  • Posted on this page
  • Dated with a "Last Updated" notice
  • Notified through application updates (for significant changes)

Continued use of EchoCraft after changes constitutes acceptance of the new Terms.

10. Termination

10.1 By You

You may stop using EchoCraft at any time by uninstalling the application. Your license remains valid for future installations.

10.2 By Us

We may terminate or suspend your access to EchoCraft immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Misuse the Software
  • Share or distribute license keys

11. Export Restrictions

EchoCraft may be subject to export control laws. You agree to comply with all applicable export and import laws and regulations. You may not export or re-export the Software in violation of any applicable laws.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and MANTISWARE regarding the use of EchoCraft and supersede all prior agreements and understandings.
